Florida property insurance claims: the deadlines and the fee cap
- Notice of a claim
- Under Fla. Stat. §627.70132, a property insurance claim or reopened claim is barred unless notice was given to the insurer within 1 year after the date of loss. A supplemental claim is barred unless notice was given within 18 months after the date of loss. — Fla. Stat. §627.70132(2)
- Time to bring a court action
- An action for breach of a property insurance contract must be brought within 5 years, running from the date of loss. This is a separate clock from the notice deadline, and §627.70132(5) states that the notice statute does not affect it. — Fla. Stat. §95.11(2)(e)
- What a public adjuster may charge
- A public adjuster’s compensation is capped at 20 percent of the amount of insurance claim payments or settlements, exclusive of attorney fees and costs, paid to the insured by the insurer. For claims based on events that are the subject of a declaration of a state of emergency by the Governor the cap is 10 percent, and that limit applies to claims made during the year after the declaration of emergency. — Fla. Stat. §626.854(11)(b)
- Which deadline applies to you
- Which of these applies to your claim depends on your policy and your date of loss.

America’s Seaplane City Sits on the Water — and That’s the Claim
Tavares is built on the Harris Chain, and water is the town’s identity — and its claim profile. Lakefront and near-water property takes storm exposure from every direction — wind coming unbroken across open water, driving rain, and the roof damage that follows.
And water is the loss carriers underpay more than any other, for one reason: the real damage is behind the wall, and nobody opens the wall. A carrier adjuster spends twenty minutes in a house, photographs what’s visible, and writes a number for what’s visible. The moisture that traveled into the framing and subfloor gets found six months later — as mold, when the claim is already closed. Tavares also carries older housing around downtown, which hands carriers their favorite three words: pre-existing, maintenance, wear and tear.
The Losses We Handle in Tavares
- Water damage — Florida’s most underpaid loss, and the one this town is built for
- Roof, wind & storm — unbroken exposure across the Chain
- Mold — the second disaster that grows out of the first underpaid one
- Hail — routinely dismissed as “cosmetic”
- Fire & smoke — contents valuation quietly cut
- Hurricane — where deductibles and exclusions land hardest

The Thing Most Homeowners Never Learn
How a loss is described and documented at the very start can decide what it ends up being worth. There is a right way and a costly way, and most people find out which one they used only after it is already on the record. That is exactly what we handle.
Denied? A denial is a position, not a verdict. We re-document and work to reverse it.
Underpaid? We pursue what your policy actually owes.
Serving Tavares and the Golden Triangle.
